Welcome to GatiRath. These Terms and Conditions govern your access to and use of GatiRath’s car booking and car rental services, website, mobile application, and any other associated platforms operated by GatiRath (collectively referred to as the “Service”).

By accessing, browsing, booking, or using our Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services.

1. Definitions

“GatiRath” refers to the car booking and renting company operating under the brand name GatiRath.

“User”, “You”, “Customer” refers to any individual or entity who accesses or uses the Service.

“Driver” refers to a chauffeur assigned by GatiRath or its partner operators.

“Vehicle” refers to any car, cab, or automobile provided for booking or rental through GatiRath.

2. Eligibility

To use GatiRath services, you must be at least 18 years of age and legally capable of entering into a binding contract under Indian law. By using the Service, you represent and warrant that you meet these requirements.

3. Scope of Services

GatiRath provides intercity, local, airport transfer, round-trip, and rental car services with or without drivers, depending on availability and booking type.

GatiRath acts as a facilitator between customers and vehicle operators and does not own all vehicles listed on the platform.

4. Booking and Confirmation

All bookings made through GatiRath are subject to availability. A booking is considered confirmed only after you receive a confirmation via SMS, email, or in-app notification.

GatiRath reserves the right to cancel or modify bookings due to operational constraints, vehicle unavailability, safety concerns, or force majeure events.

5. Pricing and Payments

Prices displayed on the platform are base fares and may be subject to additional charges such as tolls, parking fees, state taxes, night charges, driver allowances, or extra kilometers.

Payments must be made through approved payment methods. Failure to complete payment may result in booking cancellation.

6. Cancellations and Refunds

Cancellation policies vary based on trip type and time of cancellation. Free cancellations may be available up to a specified period before pickup.

Refunds, if applicable, will be processed within 7–10 business days after deduction of applicable charges.

7. Driver and Vehicle Usage

Drivers are expected to follow traffic laws and ensure passenger safety. Customers must cooperate and behave respectfully with drivers.

Smoking, alcohol consumption, illegal substances, or any unlawful activities inside the vehicle are strictly prohibited.

8. Customer Responsibilities

You agree to provide accurate pickup, drop, and contact information. GatiRath is not responsible for delays or failures due to incorrect information provided by the customer.

9. Delays and Route Changes

Any route deviations, additional stops, or delays requested by the customer may result in extra charges.

10. Insurance and Liability

Vehicles are covered under statutory insurance as required by Indian law. However, GatiRath shall not be liable for loss of personal belongings.

11. Force Majeure

GatiRath shall not be held liable for delays or cancellations caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, government restrictions, or road closures.

12. Termination of Service

GatiRath reserves the right to suspend or terminate access to its services if a user violates these terms or engages in fraudulent, abusive, or unlawful behavior.

13. Privacy Policy

By using GatiRath services, you consent to the collection and use of your data in accordance with our Privacy Policy.

14. Intellectual Property

All content, logos, designs, and trademarks used on the platform are the property of GatiRath and may not be used without prior written permission.

15. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of Indian courts.

16. Amendments

GatiRath reserves the right to modify these Terms and Conditions at any time. Continued use of the service constitutes acceptance of updated terms.
